End User Licence Agrement

This End User License Agreement (the "Agreement") is a legal agreement between you (referred to herein as "User" or "You") and TKP AEPB (referred to herein as "Licensor" or "We"), governing your use of the TKP AEPB mobile application (the "App") and any related services. By installing or using the App, you agree to be bound by the terms and conditions of this Agreement.

1. LICENSE GRANT

Subject to your compliance with the terms of this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial purposes. This license does not grant you any ownership rights or intellectual property rights in the App.

2. USER-GENERATED CONTENT

a. The App allows users to generate and share content ("User-Generated Content"). You understand and agree that any User-Generated Content you create, upload, or share through the App is your sole responsibility, and you shall be solely liable for any consequences arising from such content.

b. You agree not to create, upload, or share any User-Generated Content that is illegal, obscene, defamatory, infringing, harassing, harmful, or otherwise objectionable. Licensor reserves the right to remove, block, or modify any User-Generated Content that violates this Agreement, without prior notice.

3. CONTENT MONITORING

a. Licensor does not actively monitor all User-Generated Content but reserves the right to do so at its discretion. Licensor may review, moderate, and remove any User-Generated Content that violates this Agreement or is deemed inappropriate, without liability or obligation to you.

b. Licensor may employ automated systems to identify and flag potentially violative content. However, these systems may not be perfect, and false positives or negatives may occur. Licensor encourages users to report any inappropriate User-Generated Content for review.

4. INTELLECTUAL PROPERTY RIGHTS

a. You acknowledge that the App, including its design, features, and content, is protected by copyright, trademarks, and other intellectual property rights owned by Licensor or its licensors. You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any part of the App without prior written consent from Licensor.

b. You retain ownership of any intellectual property rights in the User-Generated Content you create, subject to the license granted to Licensor in Section 5.c.

5. LIABILITY AND INDEMNIFICATION

a. Licensor shall not be liable for any damages, losses, or liabilities arising out of your use or inability to use the App, including any User-Generated Content. The App is provided "as is" and without any warranty or guarantee of any kind.

b. You agree to indemnify, defend, and hold Licensor harmless from and against any claims, demands, liabilities, damages, losses, costs, or expenses arising out of or related to your use of the App, your User-Generated Content, or your violation of this Agreement.

6. TERMINATION

This Agreement is effective until terminated. Licensor may terminate this Agreement at any time without prior notice if you breach any provision of this Agreement. Upon termination, you must cease all use of the App and delete any copies of the App in your possession or control.

7. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of Indian Jurisdiction. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Indian Jurisdiction .

8. MISCELLANEOUS

a. This Agreement constitutes the entire agreement between you and Licensor regarding the App and supersedes any prior or contemporaneous agreements.

b. If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

c. Licensor's failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.

By installing or using the TKP AEPB App, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this End User License Agreement.
